FIRST ON FOX: A House Judiciary subcommittee hearing on Wednesday will feature the testimony from a whistleblower who will warn lawmakers that the U.S. has become the ‘middleman’ in a multi-billion dollar migrant child trafficking operation at the border.

The hearing, ‘The Biden Border Crisis: Exploitation of Unaccompanied Alien Children,’ will be held by the House Judiciary Subcommittee on Immigration Integrity, Security and Enforcement and will examine the surge in unaccompanied children (UACs) at the southern border.

According to Customs and Border Protection (CBP) statistics, the number of UACs who came to the border shot up from 33,239 in FY2020 to over 146,000 in FY 2021 and 152,000 in FY 2022. So far in FY 2023 there have been over 70,000 encounters of unaccompanied children.

When child migrants are encountered at the border, they are transferred into the custody of Health and Human Services (HHS) and then united with a sponsor — typically a parent or family member already in the U.S.

But the Biden administration has been rocked by a number of reports that officials have been unable to make contact with over 85,000 child migrants, and more recently that administration officials ignored signs of ‘explosive’ growth in child labor. A number have been forced into indentured servitude to pay back smugglers and have worked in dire conditions.

The Wednesday hearing will hear from three witnesses: Tara Lee Rodas, an HHS whistleblower formerly with an inspector general’s office; Sheena Rodriguez, founder and president of Alliance for a Safe Texas; and Jessica Vaughn, director of Policy Studies at the Center for Immigration Studies.

Rodas will warn of a problem that predates the administration, but that has increased significantly during the recent migrant crisis, according to a copy of her written testimony obtained by Fox News Digital.

‘Today, children will work overnight shifts at slaughterhouses, factories, restaurants to pay their debts to smugglers and traffickers. Today, children will be sold for sex,’ she will say. ‘Today, children will call a hotline to report they are being abused, neglected, and trafficked. For nearly a decade, unaccompanied children have been suffering in the shadows.’ 

She will talk about her volunteering at an emergency intake site in California to help HHS’ Office of Refugee Resettlement (ORR) identify sponsors for minors who have come across the border.

‘I thought I was going to help place children in loving homes. Instead, I discovered that children are being trafficked through a sophisticated network that begins with being recruited in their home country, smuggled to the U.S. border, and ends when ORR delivers a child to a sponsor – some sponsors are criminals and traffickers and members of Transnational Criminal Organizations. Some sponsors view children as commodities and assets to be used for earning income – this is why we are witnessing an explosion of labor trafficking,’ she will say. 

‘Whether intentional or not, it can be argued that the U.S. Government has become the middleman in a large scale, multi-billion-dollar, child trafficking operation run by bad actors seeking to profit off the lives of children.’

Rodriguez, of the Alliance for a Safe Texas, will share her experiences at the border encountering unaccompanied children, including teenage boys who she said told her that cartel cooperatives transported children through Mexico and held them at warehouses with armed guards. She will also call for the investigation of federal agencies responsible and for the ending of releasing migrants to sponsors.

‘We can no longer turn a blind eye and pretend this isn’t happening. Congress has the power to stop this, which is why I am calling on you to do what is right,’ her testimony says.

Vaughn will call too for congressional action, including the ending of legal loopholes that she says force the government to ‘to operate a massive catch and release program for illegally-arriving alien children.’

‘They have been carelessly funneled through the custody of U.S. government agencies and contractors, and handed off to very lightly vetted sponsors (who are usually also here illegally) in our communities without regard to their safety and well-being,’ she will say. ‘There is no question that the system for processing minors who cross illegally is dysfunctional, and has been for some time, and needs to be fixed.’

Last month, HHS Secretary Xavier Becerra pushed back on the agency being unable to contact 85,000 minors, and also said HHS authorities are limited by Congress.

‘I have never heard that number of 85,000, I don’t know where it comes from and …so I would say it doesn’t sound at all to be realistic, and what we do is we try and follow up as best we can with these kids,’ he said.

‘Congress has given us certain authorities. Our authorities end when we have found a suitable sponsor to place that child with. We try and do some follow up but neither the child or the sponsor is actually obligated to follow up with us,’ he said.

Meanwhile, domestic policy adviser Susan Rice — who this week left her role — responded to the Times report that her team was show evidence of a growing migrant child labor crisis.

‘We were never informed of any kind of systematic problem with child labor or migrant child labor,’ she said.

Supreme Court Chief Justice John Roberts has declined an invitation by Senate Democrats for him, or another justice, to testify before the Senate Judiciary Committee concerning the ethics rules that govern the nation’s highest court.

The invitation from Committee Chairman Sen. Dick Durbin, D-Ill., to testify at a May 2 hearing came last week amid the controversy surrounding Justice Clarence Thomas’ trips he took with a Republican mega-donor.

‘I must respectfully decline your invitation,’ Roberts wrote the committee in a letter dated Tuesday, citing the ‘exceedingly rare’ circumstances a Chief Justice of the United States would testify before Congress, ‘as one might expect in light of separation of powers concerns and the importance of preserving judicial independence.’

Roberts cited the few instances throughout U.S. history in which a chief justice had testified before Congress on ‘routine matters’ and ‘mundane topics,’ and noted the infrequency of the Executive Branch, meaning the president, also testifying before Congress.

Additionally, he attached a Statement of Ethics Principles and Practices he said all members of the Supreme Court abide by.

Durbin released a statement responding to Roberts’ letter, saying the hearing would continue as scheduled, and vowed there would be a reform of the Supreme Court’s ethics, regardless of its participation in the process.

‘I am surprised that the Chief Justice’s recounting of existing legal standards of ethics suggests current law is adequate and ignores the obvious. The actions of one Justice, including trips on yachts and private jets, were not reported to the public. That same Justice failed to disclose the sale of properties he partly owned to a party with interests before the Supreme Court,’ Durbin said.

‘It is time for Congress to accept its responsibility to establish an enforceable code of ethics for the Supreme Court, the only agency of our government without it,’ he added.

Earlier this month, Durbin asked Roberts to open an investigation into Thomas over what Democrats say is his ‘misconduct’ that was detailed in a report by ProPublica report accusing him of improperly receiving lavish vacations from Republican mega donor Harlan Crow, which reportedly included taking trips across the world on Crow’s yacht and private jet without disclosing them.

Experts have dismissed the report as political hit piece and explained that justices are permitted to accept invites to properties of friends for dinner or vacations without paying for it or disclosing it.

Thomas released a statement following the report saying that he has consistently followed ethics guidelines, and would do so in the future.

‘Harlan and Kathy Crow are among our dearest friends, and we have been friends for over twenty-five years,’ Thomas said. ‘As friends do, we have joined them on a number of family trips during the more than quarter-century we have known them.’ 

Early in my tenure at the Court, I sought guidance from my colleagues and others in the judiciary, and was advised that this sort of personal hospitality from close personal friends, who did not have business before the Court, was not reportable,’ he said. ‘I have endeavored to follow that counsel throughout my tenure, and have always sought to comply with the disclosure guidelines.’ 

‘These guidelines are now being changed, as the committee of the Judicial Conference responsible for financial disclosure for the entire federal judiciary just this past month announced new guidance. And, it is, of course, my intent to follow this guidance in the future,’ he added.

The Minnesota House was considering a ‘red flag law’ on Tuesday to allow the temporary confiscation of guns from people judged to be an immediate threat to themselves or others, as well as a proposal for expanded background checks for firearms transfers.

The two gun measures are part of a wide-ranging public safety bill that lawmakers were expected to debate late into the night before ultimately passing it.

‘Every other industrialized nation in the world can find a way to keep their freedoms and not kill their children and their citizens,’ Democratic Gov. Tim Walz said during a rally on the Capitol steps. ‘We can have both.’

First on the House agenda for the day, however, was the completion of work that started Monday night on a contentious bill to legalize recreational marijuana. It passed 71-59. The Senate is scheduled to vote Friday on its own cannabis bill.

The public safety bill was last on the day’s agenda. Republicans pre-filed over 30 amendments to various provisions of the public safety bill, portending a long debate.

‘We tackle gun violence head-on in this bill,’ Democratic Rep. Kelly Moller, of Shoreview, chair of the House Public Safety Committee, told reporters. ‘These are common-sense measures that our constituents for years have been telling us that they want.’

The proposals have gained traction in Minnesota this year now that Democrats control both chambers of the Legislature and the governor’s office, even as the national debate over preventing gun violence becomes increasingly polarized.

In Michigan, Democratic Gov. Gretchen Whitmer signed a background check bill earlier this month and said she would sign a red flag law that is still being negotiated if it reaches her desk. But in Colorado, Democratic lawmakers killed a bill Thursday that would have banned the sale and transfer of semiautomatic firearms, illustrating that even Democratic-controlled statehouses don’t have free rein when it comes to overhauling gun laws.

And it’s not clear yet if either of the two Minnesota gun measures can get through the Senate and make it to the desk of Walz, who has pledged to sign them if they do. They aren’t in the Senate version of the public safety bill, which passed earlier this month. Moeller said supporters hope the red flag and background check provisions survive when a conference committee negotiates the final version.

While House Democrats had enough of a majority to pass the overall bill, including the gun safety provisions, Senate Democrats hold only a one-seat majority. Some Democratic senators from rural districts where hunting, shooting sports and gun ownership are traditions have avoided taking stands.

Rob Doar, a lobbyist with the Minnesota Gun Owners Caucus, said in an interview that he’s ‘pretty confident’ there won’t be enough votes in the Senate for a red flag law. He said he does expect Senate support, however, for background check language that’s stronger than current law but doesn’t go as far as the House bill.

Democratic House Majority Leader Jamie Long, of Minneapolis, said recent school shootings show the need for both provisions. He recounted to reporters how his young daughter came home a few weeks ago and told him about a shelter-in-place drill that they had conducted at her preschool.

‘We have a gun violence epidemic in our country and in our state, and right now we are putting this on our kids. And we shouldn’t,’ Long said. ‘We are at a point where the adults need to step up and protect our kids and make sure that we are doing everything we can to keep them safe.’

While Long wasn’t optimistic about getting Republican votes for the bill, he noted that GOP Tennessee Gov. Bill Lee has proposed something similar to a red flag law, and that red flag laws have won support in some red states. Lee frames his proposal as ‘temporary mental health orders of protection’ and says it’s not a red flag law. But top Republicans there don’t agree, and its chances are fading. Tennessee has become a flashpoint in the national debate in the wake of last month’s shooting at a Nashville school that killed three children and three adults.

The lead Republican on the Public Safety Committee, Rep. Paul Novotny, of Elk River, said at a news conference that the red flag proposal would violate due process and Second Amendment rights. He said the background check provision, which would apply to more kinds of gun transfers than current state law requires, would create ‘strict and impractical’ hurdles for law-abiding citizens who want to sell, give or loan guns to others.

The public safety bill also includes money for recruiting police officers, changes to the probation system aimed at reducing recidivism, increased penalties for fentanyl dealers, and grants for local nonprofits for violence prevention programs.

‘This is a transformational bill that positively impacts the safety of every Minnesotans across the state,’ Moller said.

April is Financial Literacy Month. As a retail trader or investor, you know the value of education. There’s always a new technique, tool, or strategy to learn. Sophisticated scanning tools can help identify stocks that could improve your trading process. Here’s an example of using scan results to analyze a stock before trading it.

A great daily habit for traders is to run scans to identify stocks to trade. It’s a methodical way to filter through the thousands of ticker symbols the stock market offers. One stock of interest, which showed up in a scan that looked for large-cap stocks that had a StockCharts Technical Ranking (SCTR) score crossing above 80, was Boston Scientific (BSX). Let’s analyze the chart of BSX.

After suffering a setback during the COVID-19 pandemic, Boston Scientific (BSX) has started showing signs of growth. The stock has an exciting pattern forming, which could make it a great stock to buy if the growth signs sustain. If things don’t go in the company’s favor, however, you may want to move on to another stock in your scan results.

Boston Scientific is announcing its earnings on Wednesday (April 26). Investors are likely waiting for the results before they decide to buy or sell. Will the stock continue its upward move after it reports?

The Long-Term View of BSX Stock

Looking at the weekly chart over five years, BSX is trading well above its 50-, 100-, and 200-week simple moving averages. The 50-week simple moving average (SMA) is crossing above its 100-week SMA. The 200-week SMA is showing a very gentle positive slope. A steeper upward slope would be more confirming of an uptrend.

Zeroing In: Daily Price Action

Let’s check the daily chart to see if the uptrend is in sync. The daily chart of BSX shows the 50-, 100-, and 200-day SMAs sloping upward. This agrees with what the weekly chart shows. The SCTR score displayed in the upper panel is above 80, and relative strength against the Health Care sector, using the Health Care Select Sector SPDR exchange-traded fund (XLV), is displayed in the lower panel.

In addition to the overall trend, the daily chart shows some interesting patterns you should watch.

Trend direction. In late September 2022, BSX started trending higher, with a series of higher highs and higher lows. In mid-December, the upward price movement slowed, and the stock price went through a consolidation period. It started trending lower, but broke above that downward trendline on February 1, 2023 on higher than average volume. It looked like the beginning of an uptrend, but the upward price action stalled, and the stock trended lower.Upward move resumes. On March 14, price broke above the second downward trendline. This time, the stock price stayed above the downward-sloping trendline and continued moving higher. The stock price stayed above the third trendline up until April 21, when the stock had a massive selloff and closed below the upward-sloping trendline. The stock’s price dropped on heavy volume. Since then, the trendline has been acting as a resistance level. Support and resistance. After falling below the upward-sloping trendline on very heavy volume, will the stock break back above the trendline and resume its uptrend? Boston Scientific’s earnings results could hold the key. Let’s see if the third time’s the charm. 

The Waiting Period Begins

As long as the SCTR score stays above the 70 level, price breaks out above the resistance of the upward-sloping trendline, and Boston Scientific’s performance with respect to the Health Care sector remains strong, the stock could move higher, riding on a positive earnings report. But if Boston Scientific’s earnings are not up to mark, the stock could fall to its 50-day SMA, or even lower to its 100- or 200-day SMA.

The stock is trading close to its all-time high. So, if the earnings report is favorable and the stock moves higher on strong volume, there could be a lot of upside potential. If that scenario plays out and you decide to enter a long position, place a stop loss just below that upward-sloping trendline. A move below that trendline could send the stock lower.

The Bottom Line

Scans are powerful tools that every trader or investor should use, and they can be as simple or complex as you want them to be. You can try using some of the Predefined Scans available on the StockCharts platform, or you can create one of your own. Add that to everything you’ve learned during Financial Literacy Month.

There’s a simple professional trader’s tactic for anticipating intraday market reversals near the levels that later become the high or the low of the day. This tactic worked perfectly at calling today’s high of the day in SPY (and the QQQ, IWM, and DIA). This simple indicator works even better when the market’s sector rotation leads the move like it did today, so let’s start there.

Today’s image is our sector summary table, which you can find for free in the “Big View” section of marketgauge.com. The table is ranked by 6-month change (outlined in red) because we’ve found that timeframe to be significant when gauging the persistence of trends. As you can see, there was an interesting pattern of market rotation today (pointed out by the green arrows).

The pattern is simply that the leading sector (over the last 6 months), SMH, was today’s biggest loser on a percentage basis, while in contrast, the weakest sector, XLE, was today’s biggest winner. In an otherwise quiet, choppy day, this sector rotation bookended the mood of traders who were focused on bespoke stock stories like earnings that didn’t translate into a general market trend.

If you read yesterday’s edition of this article, “SMH Bulls Are Skating On Thin Ice,” weakness in this leading sector shouldn’t come as a surprise. If you’re also aware of our simple tactics for anticipating intraday market reversals and trend days, then the trend days in both SMH and XLE should not come as a surprise, even though they were bucking their longer-term trends.

The simple tactic I’m referring to that enables you to anticipate daily highs and lows and trend days is the proper use of the Opening Range indicator.

The two-sentence tutorial for understanding the Opening Range is as follows…

The low and high of the first 30 minutes of the day will be significant support and resistance, and you should look for reversal patterns at these levels. If the market exhibits a confirmed breakout beyond the O.R. high or low, it is often a trend day.

With that in mind, look at the intra-day charts of SMH and XLE. Notice in the SMH chart that, when the price broke the OR low, it trended lower. In the XLE chart, when the price broke the OR high it rallied, retraced to the OR high area, then resumed its trend higher.

Now let’s look at the reversal at the high of the day in the SPY chart below. 

Notice I’m showing you the QQQ chart too. The simple advanced Opening Range tactic for anticipating a market reversal is to look for divergences in the indexes at the Opening Range levels. The red circles show an example of the SPY attempting to break over the OR high, while the QQQ demonstrates a significant negative divergence. When you see a divergence like this, expect the SPY to reverse.

If you consider the two sets of charts together, you can see how the SHM started the day on a positive note, but never made an attempt to move over its OR high like the SPY, indicating that the market’s leader was not bullish today. This contributed to the weakness in the QQQ.

Intraday trading patterns aren’t just for day traders. Today’s SMH chart is a good example of using the Opening Range to avoid buying into a weak day in the leading sector, but…

Bed Bath & Beyond filed for Chapter 11 bankruptcy Sunday, with plans to wind down its entire business.

The beleaguered company has laid out what the action means for its customers in an online FAQ page.

Will Bed Bath & Beyond stores and its website remain open?

Yes, for now. The company’s remaining 360 Bed Bath & Beyond and 120 buybuy BABY stores and websites will remain open and continue serving customers as the company winds down its business and seeks a buyer for its remaining assets.

When will final store sales begin?

On Wednesday. ‘We encourage you to come shop for your favorite products while merchandise selection is best,’ the company said. All store closing sales will be final.

How about product returns?

Any items purchased before Wednesday can be returned or exchanged until May 24. Any items purchased on Wednesday — the start of its closing sales — or after will be final. 

What to know if you’re registered with Bed Bath & Beyond or buybuy BABY

The company says it expects to partner with an alternative platform where registry information will be transferred. More details are expected in the coming days, it said.

‘Your registry data is safe. While registry items can no longer be purchased through our platform, you can still view your registry at this time,’ the company said.

Using Bed Bath & Beyond coupons and rewards points

Customers can redeem Bed Bath & Beyond ‘Welcome Rewards’ until May 15. However, the company is no longer awarding points for purchases.

Stores will stop accepting coupons Wednesday.  

Customers can use gift cards through May 8.

And customers can redeem merchandise credits until May 15.

Welcome Rewards+ store credit cards can continue to be used ‘at this time,’ Bed Bath & Beyond said.

‘We encourage you to shop your favorite products at deep discounts during our store closing sales, starting April 26, 2023,’ the company said.  

Can you cancel your membership for a refund? 

No. ‘While your membership is not eligible for a refund, you can continue to enjoy your membership benefits before our store closing sales begin on April 26, 2023,’ the company told customers.

Will employees continue to be paid?

Yes. Wages and benefits will be honored as the company completes the bankruptcy process.

Dean Holland, an Australian jockey, died Monday after falling during a race at Donald Racecourse, according to a news release from Racing Victoria and the Victorian Jockeys Association. Holland was 34.

The racing authority said Holland was one of two riders thrown off their horses during the race. On-course paramedics immediately treated Holland after the fall, but he died at the scene.

The Australian Broadcasting Corp. reported that Holland was nearing the finish when his horse, Headingley, veered into the inside rail.

‘It was a tragic accident at Donald today and we are all are deeply shocked and saddened that Dean has passed away as a result of injuries sustained in the fall,’ Racing Victoria chief executive Andrew Jones said in a statement. ‘Dean was a gifted lightweight rider who won over 1,000 races and was highly respected by his peers. … Dean’s passing is heartbreaking for all within Victorian racing and the sport nationally. It is a sobering reminder of the immense bravery of our riders.’

The race, which was canceled after the incident, was part of an opening race at Donald Racecourse in regional Victoria.

The other jockey who fell during the incident, Alana Kelly, avoided serious injury and both horses were unharmed, per Racing Victoria.

Victoria state police are set to issue a report for the coroner.

Holland began his career in 2005 and posted his first victory January 14, 2006 at a race in the South Australian state of Ceduna.

He most recently placed in the winner’s circle Thursday, at a race in Ararat, a town in southwestern Victoria. He last won a Group 1 race last month on a horse called In Secret in the Newmarket Handicap over 1,200 meters at Melbourne’s Flemington Racecourse. Racing.com listed Holland as having 1,080 career wins.

Drama, ejections, flagrant fouls and injuries dominated the second weekend of the NBA playoffs.

Philadelphia is the only team that has advanced to the conference semifinals. The Sixers will start the second round either Saturday or May 1, and with Joel Embiid dealing with a sprained right knee, they’re hoping for the later date so Embiid has more time to heal.

Two series are 2-1 (Los Angeles Lakers over Memphis, Miami over Milwaukee), one is 2-2 (Golden State-Sacramento) and four are 3-1 (Denver leads Minnesota, Phoenix ahead of the Los Angeles Clippers, Boston on top of Atlanta, New York in front of Cleveland).

The Dillon Brooks-LeBron James trash-talking took center stage headed into Game 3 only to be upstaged by Brooks’ ejection after striking James in groin area Saturday.

And Atlanta’s Dejounte Murray is facing possible discipline from the league after his confrontation with a referee at the conclusion of the Hawks’ loss to the Celtics on Sunday.

Here are the winners and losers from the second weekend of the NBA playoffs:

WINNERS

RJ Barrett, New York Knicks

Jalen Brunson and Julius Randle are New York’s All-Stars, but the Knicks also need Barrett’s offense. Barrett has helped the Knicks win the past two games for a 3-1 series lead with efficient offense, especially inside the 3-point line. Barrett scored 19 points in Game 3 and 26 points in Game 4 on a combined 17-for-30 from the field including 14-for-18 inside the arc.

Anthony Edwards, Minnesota Timberwolves

Denver and All-NBA center Nikola Jokic have been strong in the series, but Anthony Edwards saved the Timberwolves from elimination with 34 points in a 114-108 overtime victory. Minnesota wasted a 12-point lead late in the fourth quarter, but Edwards had five points in OT, including the game-deciding 3-pointer.

Kings-Warriors series

Tied at 2-2, this is the best series in the playoffs, complete with great games (one decided by a point, one decided by three points) and fantastic individual performances from the Warriors’ Steph Curry and Draymond Green, and the Kings’ De’Aaron Fox, Domantas Sabonis and Malik Monk.

Philadelphia 76ers

The Sixers earned their first series sweep since 1991, and now they’re rooting for the Boston-Atlanta series to go at least six games for a couple of reasons. Let those two teams get tired, and it gives the Sixers a chance to rest some players, and in the case of Embiid, a chance to get healthy after spraining his right knee in Game 3.

Devin Booker, Phoenix Suns

Booker is averaging 34.8 points, highest in the playoffs, and shooting 57.1% from the field and 43.5% on 3-pointers with games 38, 45 and 30 points (50% shooting on 3s) in the Suns’ three victories against the Clippers. He is the premier benefactor from Kevin Durant’s presence on offense. And Booker’s defense has been outstanding: 11 steals and five blocks.  

Jimmy Butler, Miami Heat

In Game 1 and Game 3 victories against Milwaukee to give the Heat a 2-1 series lead, Butler scored 35 and 30 points and shot 58.7% from the field on 27-for-46 shooting. Butler is Miami’s Mr. Do Everything, and if the Heat are going to pull off this 8 over 1 upset, Butler needs to play like that.

LOSERS

Brooklyn Nets

They had two prime chances in Games 3 and 4 to win with Philadelphia missing a star. James Harden was ejected from Game 3 in the third quarter, but the Nets blew a 96-91 lead with 2:15 left in the fourth quarter and lost. In Game 4 with their season at stake, the Nets failed to capitalize on the absence Embiid. The Sixers swept the Nets.

Los Angeles Clippers

They acquired Paul George and Kawhi Leonard in 2019 and have nothing but a Western Conference finals appearance to show for it. They lost in the conference semifinals in 2020, conference finals in 2021, didn’t make the playoffs last season and are down 3-1 against the Suns this season. Over four seasons and 308 regular-season games, Leonard and charge have played together in just 107 games, including no games last season when Leonard was injured. George is likely out for the Suns series, and Leonard missed Game 3. Their record together is stellar (83-35). They’re not just on the court together for enough games.

Dillon Brooks, Memphis Grizzlies

Brooks ran his mouth at Lakers star LeBron James during and after Memphis’ Game 2 victory. Brooks said he likes to poke the bear. He should know better. There’s a long line of people who poked James, and it didn’t turn out well from Lance Stephenson to Joakim Noah to Klay Thompson. Brooks was not at his best in Game 3 – ejected for hitting James in the groin area and shot just 3-for-13 from the field for seven points in the Lakers’ 111-101 victory. Brooks is better off, at least in this series, focused on basketball.

Donovan Mitchell, Cleveland Cavaliers

Mitchell was 1-for-9 for just two points in the second half of Game 4 on Sunday. He missed his first eight shots of the half and his bucket came with 2:13 left in the fourth quarter. He finished with just 11 points on 5-for-18 shooting, including 0-for-4 on 3-pointers. Mitchell also had six turnovers. This is nothing Mitchell, who will be an All-NBA selection this season, doesn’t know: the Cavs can’t win if he plays like that.

Milwaukee’s defense

Even without Giannis Antetokounmpo, the Bucks have outstanding defenders: Jrue Holiday, Brook Lopez and Khris Middleton. The Heat were 23-for-36 in the paint and 16-for-33 on 3-pointers. The Bucks defense is in disarray minus Antetokounmpo, but they also have enough talent and institutional knowledge to play better defense if Antetokounmpo is not on the court.

Injuries

Injuries stink, and through one week of the NBA playoffs, they have had an impact on several series and have the potential to impact conference semifinals, conference finals and NBA Finals.

Embiid has a sprained right knee, missed Game 4 against Brooklyn and Sixers coach Doc Rivers said it’s 50% at best that Embiid will be ready for the start of the next series.

Clippers’ star forward Kawhi Leonard (sprained right knee) missed the past two games – both Suns victories – and the Clippers trail 3-1 in the series. The Clippers have competed without Leonard but not well enough to win without him.

Milwaukee’s Giannis Antetokounmpo missed Games 2 and 3 – a split for the Bucks – and his absence is notable in the Heat’s 2-1 series lead.

Miami’s Victor Oladipo, who has battled injuries in his career, is out for the season after sustaining a torn patellar tendon in his left knee against Milwaukee in Game 3.

Just awful.

Perhaps this is the apex. 

From here, maybe it is a long tumble back into mediocrity for the Pittsburgh Pirates, who are coming off consecutive 100-loss seasons and finished last or next-to-last the past five seasons. 

Yet for the moment, there’s plenty to savor at PNC Park. 

The Pirates are off to a 16-7 start, their best since the 1992 club of Barry Bonds and  Doug Drabek and Co. won 16 of their first 22, before a seven-game NLCS loss and Bonds’ departure began a two-decade playoff slumber.

Ownership remains laser focused on operating a 21st century club at 20th century salaries, but a rogue band of homegrowns and retreads have defied the odds thus far. Sunday, Phillies castoff Vince Velasquez had perhaps the best start of his career, striking out 10 Reds and holding them to two hits in seven shutout innings for their seventh consecutive win. Five of their 16 victories have come against the Reds, and their sweep of Boston is their lone series win against a club with a winning record.

Tuesday, the Dodgers come town, starting a 12-game stretch that includes six against the Rays and Blue Jays. Perhaps the course will correct but for now, the Pirates are the biggest movers in USA TODAY Sports’ power rankings.

The Milwaukee Bucks, looking to avoid falling into a bigger hole in their first-round NBA playoff series against the Miami Heat, will reportedly have their star back on the floor Monday night for Game 4.

Giannis Antetokounmpo will return to the lineup barring any setbacks from his back contusion injury, according to Stadium. The two-time NBA Most Valuable Player had missed Games 2 and 3 of the series, which Milwaukee split with Miami. 

During a Monday morning shootaround in the Kaseya Center in Miami, the site of the game, Antetokounmpo, 28, was on the floor with his teammates, apparently unrestricted.

Antetokounmpo, a six-time All-NBA performer and seven-time All-Star, is one of the game’s most dangerous players with his size, speed and agility. During the regular season, he averaged 31.1 points, 11.8 rebounds and 5.7 assists per game.

The No. 8 seed Heat, who are facing injury issues of their own, have opened a 2-1 lead against top-seeded Milwaukee after Miami blew out the Bucks Saturday night.

How did Giannis Antetokounmpo’s back injury happen?

On April 16, with 4:13 left in the first quarter of Game 1 of the series, Antetokounmpo was driving to the hoop, when Heat forward Kevin Love attempted to draw a charge. Antetokounmpo landed awkwardly on his lower back and instantly was writhing in pain.

Antetokounmpo remained on the floor for several moments before getting up to take two free throws that resulted from the Love foul. A couple of minutes later, Antetokounmpo headed into the locker room for evaluation. He returned midway through the second quarter but was on the floor for only a little more than a minute. Antetokounmpo was later declared out for the rest of the game. 

Antetokounmpo had been listed as doubtful for Game 2, though his status was upgraded to questionable. He was listed as questionable for Game 3.

When is Game 4 of the Milwaukee Bucks vs. Miami Heat?

Tipoff is scheduled for 7:30 p.m. ET Monday night at the Kaseya Center in Miami.
